As an authorized affiliate (Affiliate) of energetisch.fit Online Analysis and Therapy Software, you agree to abide by the terms and conditions contained in this agreement (Agreement). Please read the entire Agreement carefully before registering and promoting energetisch.fit Online Analysis and Therapy Software as an Affiliate.

Your participation in the program is solely for the purpose of legally promoting our website to earn a commission on memberships and products purchased by individuals referred to energetisch.fit Online Analysis and Therapy Software through your own website or personal referrals.

By signing up for the energetisch.fit Online Analysis and Therapy Software Affiliate Program (Program), you agree to be bound by this Agreement and its terms and conditions.

Approval or rejection of the application

We reserve the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You have no recourse against us for rejection of your Affiliate Program application.

Commissions

Commissions are paid out once a month. For an affiliate to receive a commission, the referred account must remain active for at least 31 days.

You cannot refer yourself and you will not receive any commission on your own accounts.

Payments are only sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

Termination

Your partner application and status in the program may be suspended or terminated for any of the following reasons:

• Inappropriate advertising (false claims, misleading hyperlinks, etc.).
• Spamming (mass e-mails, mass newsgroup postings, etc.).
• Advertising on websites that contain or promote illegal activities.
• Failure to disclose the affiliate relationship for a promotion that is deemed an endorsement under existing Federal Trade Commission guidelines and regulations or applicable state law.
• Infringement of intellectual property rights. energetisch.fit Online Analysis and Therapy Software reserves the right to demand license agreements from those who use energetisch.fit Online Analysis and Therapy Software trademarks to protect our intellectual property rights.
• Offering discounts, coupons or other promised kickbacks from your affiliate commission as an incentive. However, adding bonuses or bundling other products with energetic.fit online analysis and therapy software is acceptable.
• Self-referrals, fraudulent transactions, suspected affiliate fraud.

In addition, energetisch.fit Online Analysis and Therapy Software reserves the right to terminate any affiliate account at any time for breach of this agreement or without cause.

Affiliate links

You can use graphic and text links both on your website and in your e-mail messages. You can also advertise the energetisch.fit online analysis and therapy software website in online and offline classified ads, magazines and newspapers.

You may use the graphics and text we provide or create your own as long as they are deemed appropriate under the Terms and do not violate the provisions described in the Termination section.

Voucher and deal sites

energetisch.fit Online Analysis and Therapy Software occasionally offers coupons for select affiliates and for our newsletter subscribers. If you have not pre-approved / assigned a branded coupon, you may not promote the coupon. Below are the terms and conditions that apply to any affiliate considering promoting our products in relation to a deal or coupon:

• Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything other than currently authorized business is being conducted with the respective affiliate.
• Affiliates may not offer energetic.fit Online Analysis and Therapy Software coupons, energetic.fit Online Analysis and Therapy Software discounts or other phrases indicating that coupons are available.
• Affiliates may not generate pop-ups, pop-unders, iframes, frames or other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a particular savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must direct the visitor to the merchant's site.
• The user must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. "click here to see coupons and open a window to the merchant website" is NOT allowed).
• Affiliate websites may not have a "click for (or to see) deal/coupon" or a variation if no coupons or deals are available and the click opens the merchant website or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.

Pay-per-click policy (PPC)

PPC bids are NOT permitted without prior written authorization.

Liability

energetisch.fit Online Analysis and Therapy Software shall not be liable for indirect or incidental damages (loss of sales, commissions) due to affiliate tracking errors, loss of database files or consequences of damage to the program and/or our websites.

We make no warranties, express or implied, with respect to the Program and/or the memberships or products sold by energetisch.fit Online Analysis and Therapy Software. We make no claim that the operation of the Program and/or our website(s) will be error-free, and we will not be liable for any interruptions or errors.

Term of the agreement

The term of this agreement begins when you join the program and ends when your affiliate account is terminated.

The terms of this Agreement may be changed by us at any time. If any change to the terms of this Agreement is unacceptable to you, your only choice is to terminate your Affiliate Account. Your continued participation in the Program constitutes your acceptance of any change.

Confirmation code

Affiliate shall indemnify energetic.fit Online Analysis and Therapy Software and its affiliates, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by energetic.fit Online Analysis and Therapy Software from all liabilities, damages, fines, judgments, claims, costs, losses and expenses (including reasonable attorneys' fees and costs) arising out of or relating to any and all claims arising in connection with this Agreement due to the negligence. Affiliate's misrepresentation, nondisclosure or willful misconduct.

Effective electronic signatures

The Agreement is an electronic contract that sets forth the legally binding terms and conditions of your participation in the energetisch.fit Online Analysis and Therapy Software Partner Program. You agree to be bound by this Agreement and all terms and conditions contained or referenced in this Agreement by completing the energetisch.fit Online Analysis and Therapy Software application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
